Pre-contractual information pursuant to Article 49 of Legislative Decree no. 206 of 6 September 2005 – Italian Consumer Code

The pre-contractual information set out below also forms an integral part of the “general terms and conditions of online sale www.ghisanativa.it”; they may not be amended unless otherwise expressly agreed with the Customer.

1) Identification of the Supplier

FONDERIA FINCO SRL with registered office in Marsango di Campo San Martino, via Palladio no. 6 35010 (PD), registered with the Chamber of Commerce of Padua at no. PD-196364 of the Register of Companies, tax code no. 02004550287 VAT no. 02004550287, hereinafter the “Supplier”.

2) Main characteristics of the products

The products are indicated, including their essential characteristics, directly on the Supplier’s Website on the page: www.ghisanativa.it. For each product viewed, the Customer will be able to access a specific data sheet containing the main information and data relating to the product itself.

3) Total price of products

All sales prices of the products contained in the Supplier’s online catalogue are expressed in Euros and include VAT and any other taxes.

By filling out the purchase order, and in any case before the purchase procedure is completed, the Customer will be able to verify these costs and charges.

Finally, the prices indicated in correspondence with each of the goods offered to the public are valid until the date indicated in the catalogue, or until the Supplier, at its own discretion, modifies them.

4) Methods of payment

Payment of the price may only be made by one of the methods expressly indicated below:

The Supplier guarantees that all communications relating to payments take place on a special line protected by an encryption system; the Supplier also guarantees the storage of this information with an additional level of security encryption and in compliance with the provisions of current legislation on the protection of personal data.

5) Delivery methods and times

The products will be delivered by courier.

Product delivery times are reported on the Supplier’s Website and may vary depending on the place of destination of the products. By filling out the purchase order, and in any case before the purchase procedure is completed, the Customer will be able to check the delivery times.

Moreover, if the Supplier is not able to deliver within the term indicated at the time of purchase, he will in any case promptly inform the Customer by e-mail to the address indicated by the latter when registering his personal data. In any case, delivery times shall not exceed 30 (thirty) days from the completion of the purchase procedure.

6) Right of withdrawal and refund procedures

The Customer has the right to withdraw from the purchase commitments, without penalty and without having to specify the reason, within 14 (fourteen) days from the date of receipt of the purchased product.

If the Customer decides to avail himself of the right of withdrawal, he must notify the Supplier within the aforementioned period, using the “Withdrawal Form* that can be found at the end of this web page, and then sending it according to the online procedure provided therein, or by written communication to be sent to the e-mail address info@ghisanativa.it and ordini@ghisanativa.it or by fax to 049/552630.

In any case, the supplier shall immediately acknowledge receipt of the Customer’s notice of withdrawal by sending the customer an e-mail.

The Customer shall return the products at the latest within 14 (fourteen) days from the date on which he/she informed the Supplier of his/her decision to withdraw. The return shall be made by courier. The goods must be returned in the same packaging in which they arrived. The only costs payable by the Customer for exercising the right of withdrawal are the direct costs for returning the products to the Supplier. In any case, to be entitled to a full refund of the price paid, the products must be returned intact and, in any case, in a normal state of preservation.

The Supplier shall refund the full amount paid by the Customer within 14 (fourteen) days of receipt of the notice of withdrawal. The refund shall be credited using one of the methods proposed by the Supplier for payment of the price and therefore chosen by the Customer at the time of purchase.

7) Guarantees and assistance procedures

Pursuant to Articles 128 et seq. of Legislative Decree no. 206 of 6 September 2005 (Italian Consumer Code), the Supplier shall be liable to the consumer for any production anomaly that the customer may experience upon delivery of the product. The product is accompanied by a product serial number and an instruction and maintenance booklet.

There is a lifetime guarantee for cookware and for stoves the guarantee period is 26 months from delivery.

The guarantee is void in the event of improper use or abuse of the product; deliberate damage; alterations and discolouration due to normal wear and tear; the effects of falls and knocks; the consequences of misuse such as abrasions, stains and corrosion; the results of using acids, solvents or aggressive cleaning agents; damage due to intense and prolonged electromagnetic fields.

The customer shall lose all rights if he does not notify the supplier of the lack of conformity within 2 (two) months from the date on which the defect was discovered. Notification is not necessary if the supplier has acknowledged the existence of the defect or concealed it.

In any case, unless proven otherwise, it shall be presumed that the lack of conformity that becomes apparent within 6 (six) months after delivery of the product already existed on that date, unless this assumption is incompatible with the nature of the product or the nature of the lack of conformity.

In order to benefit from the legal guarantee, it is necessary to provide proof of the date of purchase and delivery of the product.

In the event of a lack of conformity, the customer may request the repair or replacement of the product purchased, a reduction in the purchase price or the termination of this contract, alternatively and free of charge, under the conditions set out below, unless the request is objectively impossible to satisfy or is excessively onerous for the Supplier pursuant to Article 130, paragraph 4, of the Italian Consumer Code.

The request must be sent in writing by e-mail to the Supplier, who will indicate his willingness to carry out the request, or the reasons that prevent him from doing so, within 7 (seven) working days of receipt. In the same communication, if the supplier has accepted the customer’s request, he shall indicate the method of shipment or return of the product as well as the deadline for the return or replacement of the defective product.

If repair or replacement is impossible or unreasonably expensive, or if the supplier has not repaired or replaced the product within the aforementioned period, or if the replacement or repair previously carried out has caused the customer considerable inconvenience, the customer may, at his option, demand an appropriate price reduction or termination of the contract. In this case, the customer shall send his request to the supplier, who shall indicate his willingness to carry it out, or the reasons why he is unable to do so, within seven working days of receipt.

In the same communication, if the supplier has accepted the customer’s request, he shall indicate the proposed price reduction or the procedures for returning the defective product. In such cases, it shall be the responsibility of the customer to indicate how the sums previously paid to the supplier are to be re-credited.

8) Communications and complaints

Written communications addressed to the Supplier and any complaints will be considered valid only if sent to the following address: Via Palladio 6 Marsango (PD) 35010, or sent by fax to the number 049/552630, or sent by e-mail to the following address info@ghisanativa.it and ordini@ghisanativa.it.

9) Other information

For the settlement of any disputes, please refer to Article 15 of the “general terms and conditions of online sale www.ghisanativa.it”

10) Conclusion of the contract

With regard to the methods and terms for concluding the online purchase procedure, please refer to Article 3 of the “general terms and conditions of online sale www.ghisanativa.it”.

11) Product availability

The products offered by the Supplier are subject to the availability conditions set out in Article 5 of the “general terms and conditions of online sale www.ghisanativa.it”.
